Dear Ms. Enskaitis (Letter #1 of 2 dated Sept. 11, 2011),

Thank you for your September 9, 2011 response to my letter of August 12, 2011, the first of two letters which I received from Xeneca on Friday evening, September 9. I note that you did not send Xeneca’s September 9 letter of response to me until 5:51 P.M. on September 9. That timing was after the close of business hours including the close of the Post Office so Xeneca denied me the opportunity to include my reaction to its response before I sent my September 9, 2011 XpressPost letter to Minister Wilkinson and copied to you (copy attached). As I explained in that letter to Minister Wilkinson, Friday afternoon, September 9 was the last possible time that Xpress Post mail leaving my home community would arrive at the Minister’s desk by Monday, September 12, the deadline for a request for a Part II Order. I find the timing of Xeneca’s response to my Aug. 12 letter unhelpful for resolving identified issues by September 12.

There are some positive components in Xeneca’s first of two September 9, 2011 letters to me.
1. There is a civil tone in your response so that augers well for our future dialogue.
2. Re my Concern #C: Xeneca provides thanks that my comments will assist in the preparation in future EAs. Although that is good news, my current concern is with The Chute proposal which Xeneca does not address in its response to this concern, indicating that Xeneca does not intend to reissue the EA with the improvements which I suggested. I am not satisfied with Xeneca’s September 9 response to me in this regard.
3. Re my Concern #D: Xeneca indicates that it will seek to clarify this section in further EAs. Although that is good news, my current concern is with The Chute proposal which Xeneca does not address in its response to this concern. I am not satisfied with the Xeneca’s September 9 response to me in this regard.
4. Re my Concern #E: I agree with Xeneca that assessment of cultural values is an ongoing part of the consultation process. Although I am pleased that respect for Aboriginal culture is a crucial component of Xeneca’s corporate pholosophy my concern is about the way that corporate philosophy is implemented where Aboriginal cultural values are compromised by Xeneca’s proposal at The Chute. I will continue to monitor this matter. Xeneca’s focus on policy rather than policy implementation is a cause for fresh concern. I am not satisfied with Xeneca’s September 9 response to me in this regard.

Regarding several other concerns which I raised in my August 12 I am not satisfied with Xeneca’s September 9 response to me. Accordingly, because of the significant number of unresolved matters between Xeneca and me, I confirm my September 9 request to Minister Wilkinson for a Part II Order so that these unresolved matters can be addressed.

I will respond separately to Xeneca’s second September 9, 2011 letter to me which you sent at 7:20 P.M. Friday evening, September 9.
